Eh, yes and no. Juries tend to be a pretty solid mix of age groups, in my experience. Old people are *slightly* overrepresented but that's mostly because they're retired and have nothing better to do so they don't try as hard to get out of jury duty. However most people, regardless of age, don't like perverts. On the other hand there's usually not actually all that much nuance at play.

Yeah, those are arguments that could be made. Ultimately though you have to convince the jury (judge wouldn't be making this decision except at a preliminary hearing or motion to dismiss, where any questions of fact are resolved in favor of the prosecution) that it was actually, legitimately, seriously intended to primarily be artistic expression or a political critique. You can't just shoot a normal threesome porno, have the guy wear a T-shirt that says "the popular vote" and the girls wear donkey and elephant masks and claim that it has serious political value.
