Libertarian Theory of Capital Punishment Anonymous 02/22/2020 (Sat) 16:52:01 Id: 4e4159 No. 1967

Supposing that capital punishment is valid for sufficient crimes, where does the right to execute lie? I'd like to specifically think about the crime of murder.

Murray Rothbard wrote the following:
>>1967
If I understand what your asking right then in most cases it probably would be the victims next of kin, or whoever has the most prominent position in his will, but if you want to be sure I'm sure you could specify how you want your murderer punished in your will or something. But assuming you don't then again I guess its up to your family or community to deal with it.

Though if your asking if murderers should be executed then yes.

Not quite, I'm asking if there's a term for the idea that the right/obligation to execute is publicly shared, even if the heirs have special priority.
Thats what the scripture seems to indicate, and I would argue natural law. If I witness the murder of an innocent, I am within my right to kill that man even without heirs and not being a victim myself.

The legal principle of estoppel provides something of the sort. Estoppel stipulates that those who do not follow a given principle are not entitled to appeal to said principle in their own defense. Communists and other thieves who do not recognize private property norms and regularly violate them have no right to appeal to private property norms to protect their own private property. Likewise, murderers who have no respect for nonaggression or the self-ownership of others have no right to appeal to nonaggression or their own self-ownership in their own defense.

Wouldn't people who own property set their own laws for what happens to murderers on their property?

>estoppel
thanks

Do you think that this concept of shared right to execute murderers conflicts with property right of the owner of the crime scene?
Should he be allowed to supercede the shared/special right of someone else to execute the murderer?

The NAP is essentially based on estoppel, it's kinda like asking "does the NAP conflict with property rights?", the NAP/estoppel by itself is not the law, but it is the foundation on which property owners can make their own laws and coexist with other property owners in an ancap society. Ancap isn't about living on your property purely by the NAP/estoppel, that would be chaotic, and people will naturally add their own laws for their own property according to their own preferences. The property owner ultimately decides the policy in regards to murderers and what counts as murder on his property, so if you witness a murder, you better be sure that killing him is actually allowed.

Yes, I'm a libertarian because I trust other people to make sound judgements, so I'm sure they're not gonna kill anyone by mistake and will be able to be fair in executing capital punishment.
You american libertarians are seriously retarded.

They exhibit the same soy addled Utopian Impossibility syndromes just like the Marxists except that their version is the Mad max mob rule version for mental midgets.

What a nigsoc waste of good dubs
Why pay taxes or buy a business license if the government closes roads and closes businesses?
>>2055 I know this is an old post on a dead board but I don't care. Holy shit what a retarded image, gas yourself. >a person or organization can just break their contracts with everyone forever and people will continue to do business with them no matter what because uh...because they just will okay? Imagine having a strawman argument so flimsy it gets blown the fuck out by the existence of Google Maps reviews and Yelp
>>2000 depends on whether they are part of a covenant or not
Resistance becomes a duty when you live in a police state. Why is Assange in jail, but Clinton isn't? Why did Snowden throw away his life to warn Americans about the dangers of tyranny? How can officials and the Gestapo take an oath to defend the Constitution and then violate it everyday? Is a paycheck more important than freedom?
>>5181 Let me know the use of your google reviews after a private McCourt has executed you. Some things just cannot be allowed, killing is one of them. I don't trust my fellow man, which is why I want the system of profit and loss to make the final choice
Americans scream that you must have tyranny or you will have racism and pollution, but the US is a police state now and there is still racism and pollution.
